Free California Month-to-Month Rental Agreement Download
The California Month-to-Month Rental Lease created pursuant to the California Civil Code § § 1925 to 1954.1; 1961 to 1995.340. It applies to private dwellings leased for residential use in a month-to-month tenancy agreement. Even though the tenancy agreement is month-to-month, proper notice is required to terminate tenancy.
Steps to Fill the California Month-to-Month Rental Agreement
- Enter the date, the name and address of the landlord or agent, and the names of all residents.
- Enter the address of the premises.
- Enter the date of the month on which rent is to be paid, the amount of rent to be paid, the tenancy start date, any proration of rent, and instructions for paying the rent.
- Indicate the amount and conditions of the security deposit.
- Tenant agrees to pay utilities. Indicate conditions for utilities.
- Indicate amount and conditions for late fees and returned check fees. Landlord may choose how to allocate payments and may require payment by certified funds.
- Landlord’s liability will be limited if premises are not ready for occupancy.
- Tenant agrees that premises are in satisfactory condition.
- List any occupants who are not on the rental agreement and indicate conditions for guests.
- Indicate conditions for renter’s insurance.
- Enter number of keys that tenant receives.
- Indicate conditions for parking, storage, and landscaping.
- Indicate smoking policy and attach addendum if included.
- Tenant agrees not to sublet the premises and to certain prohibitions.
- Tenant agrees to allow landlord or agent access for maintenance.
- Tenant agrees not to make alterations without consent and agrees to care, clean, and maintain the premises.
- Tenant agrees that the premises will be used only as a residence, to not violate quiet enjoyment, and to comply with local rules, codes, and ordinances.
- Tenant agrees to change batteries in smoke and carbon monoxide detection devices.
- Tenants agree to be jointly and severally liable and that defaults may be reported to the appropriate agencies.
- Tenant agrees to comply with sale or refinance of the property.
- Tenant indicates receipt of disclosures and addenda.
- Enter name and address of landlord’s agent for service of notices and process.
- All residents and the landlord or agent must sign and date this Month-to-Month Rental Lease Agreement, which complies with California Law.
- The California Law requires all Landlords or Agents to provide information about bedbugs to their tenants and hence the Bedbug Addendum must also be completed.
